Samuel Larkin was charged with being of unsound mind. Senior Constanle Anderson deposed that he knew accused. In February last accused was charged with being of unsound mind, but was subsequently discharged. In consequence of complaints received he went to the residence of accused's father at about 9 p.m. on Wednesday last. He knocked at the door, which was open, and prisoner rushed out. He spoke to the accused, but he made no reply. He then caught hold of accused, and with assistance put him to the ground. Accused was in a fit and very violent. He brought accused to the lockup where he charged him of being of unsound mind. Prisoner's father was with him. The father had sent for the police on several occasions. From what he had seen and heard he had no doubt that prisoner was of unsound mind. John Larkins deposed he was a labourer residing in Peter-Street, Wagga. Accused was his son and resided with him. He had to take proceedings against his son in February last, and he was subsequently discharged. Prisoner was then better for a time, but the last few weeks he had been getting worse. Prisoner was in the habit of sneaking out at night and throwing things on people's houses. He had recently had to leave the house because the neighbours were so frightened. Prisoner was often walking about all night and endangered the house with the tires. Prisoner had been very violent and witness considered he was insane. Erasmus Wren deposed he was a legally qualified medical practitioner and surgeon at the Wagga gaol. Accused was under his care some time ago. He had seen the prisoner that morning, and did not consider him fit to be at large. He recommended that accused be remanded for a week, when he would be better able to speak as to his state.
